This Refund & Cancellation Policy (the “Policy”) explains how refunds, cancellations, subscription renewals, failed payments, chargebacks, optional services, and release availability after cancellation are handled by All Humans Cry (“All Humans Cry,” “we,” “us,” or “our”).
This Policy forms part of and is incorporated into our Terms of Service, Distribution Agreement, Royalty & Payout Policy, Anti-Fraud Policy, Copyright & Takedown Policy, and any other applicable agreement or policy published by All Humans Cry.
By creating an account, purchasing a subscription, submitting a release, using the dashboard, requesting services, or otherwise using All Humans Cry, you agree to this Policy.
1. Scope of this Policy
This Policy applies to all users, artists, labels, managers, representatives, consumers, business users, rights holders, and any other person or entity using the services of All Humans Cry.
This Policy applies to all subscriptions, renewals, cancellations, refunds, failed payments, chargebacks, payment disputes, optional services, custom label services, release submissions, release rejections, dashboard access, payout access, support access, and related services.
Refunds are available only under the specific conditions described in this Policy or where required by mandatory applicable law.
2. Subscription Model
All Humans Cry offers yearly subscription plans.
Current subscription plans may include:
- Artist;
- Label;
- Label+;
- Custom Label Plan.
Custom Label Plans may be subject to separate written terms, pricing, refund rules, cancellation rules, and service conditions agreed on a case-by-case basis.
Subscriptions automatically renew every year unless cancelled before the renewal date. By purchasing a subscription, you authorize All Humans Cry and its payment processor to charge the applicable subscription fee and renewal fee using the payment method provided.
Users may cancel their subscription at any time through the Stripe billing portal where available or by contacting All Humans Cry through the support ticket system.
Cancelling a subscription stops the next renewal. Cancellation does not automatically terminate the current paid subscription period. Unless otherwise stated or required by law, the subscription remains active until the end of the current paid period.
All Humans Cry currently offers yearly subscriptions only. Monthly subscriptions are not currently offered unless expressly made available by All Humans Cry in the future.
3. General Refund Position
Refunds are not automatic.
A refund may be available only if all applicable conditions in this Policy are met. All Humans Cry may refuse refunds where a user has breached the Terms of Service, this Policy, the Anti-Fraud Policy, the Copyright & Takedown Policy, the Royalty & Payout Policy, the Distribution Agreement, or any other applicable policy.
All Humans Cry may, at its sole discretion, provide a goodwill refund, credit, or other resolution on a case-by-case basis. A goodwill refund does not create any obligation to provide refunds in other cases and does not waive our rights under this Policy.
4. First 30-Day Refund Eligibility
A user may request a refund within 30 calendar days after purchase only if:
- the user has not submitted any songs, releases, audio files, artwork, metadata, or release-related materials for review, processing, distribution, monetization, or delivery; or
- none of the user’s submitted songs or releases are approved within the first month of the subscription, provided that the rejection was not caused by the user’s breach, fraud, missing rights, false information, or non-compliance.
The refund request must be submitted within the first 30 calendar days after purchase.
After the 30-calendar-day refund window has expired, the subscription fee is non-refundable unless required by mandatory applicable law or approved by All Humans Cry as a goodwill exception.
5. When a Subscription Becomes Non-Refundable
A subscription becomes non-refundable once the user submits a release or uses the services in a way that causes All Humans Cry to begin work, review, processing, checks, delivery, support, or service performance.
This includes, but is not limited to, where All Humans Cry:
- receives a release submission;
- reviews a release;
- checks audio, artwork, metadata, rights, or eligibility;
- approves a release;
- rejects a release;
- processes a release;
- delivers or attempts to deliver a release;
- submits a release to Too Lost or another distribution partner;
- provides dashboard services;
- provides analytics or reporting access;
- provides artist support;
- provides playlist pitching;
- provides marketing support;
- provides YouTube Content ID services;
- provides TikTok, Instagram, Facebook, or other social monetization services;
- provides custom label services;
- provides any other service connected to the subscription.
Once any of the above has occurred, the subscription is non-refundable to the fullest extent permitted by applicable law.
6. Non-Refundable Situations
Refunds may be refused if the user:
- committed fraud;
- used artificial streaming;
- uploaded infringing content;
- uploaded music without rights;
- used fake, misleading, or inaccurate metadata;
- impersonated another artist, label, company, brand, or rights holder;
- submitted fake tax details;
- submitted fake payout details;
- submitted fake identity information;
- failed proof-of-rights checks;
- failed KYC or verification checks;
- caused rejection by All Humans Cry, Too Lost, a DSP, a distribution partner, payment provider, or other partner;
- violated the Terms of Service;
- violated the Anti-Fraud Policy;
- violated the Copyright & Takedown Policy;
- violated the Royalty & Payout Policy;
- initiated an improper chargeback;
- abused support channels;
- created multiple accounts to bypass rules;
- submitted illegal content;
- caused legal, financial, copyright, fraud, payment, operational, reputational, or partner risk.
Refunds are not available where rejection, suspension, takedown, account restriction, or account termination is caused by the user’s conduct, content, account information, payment activity, metadata, missing documentation, rights issue, or breach of policy.
7. Rejected Releases
If a release is rejected because of user fault, no refund is owed.
User fault includes, but is not limited to:
- copyright issues;
- missing rights;
- missing licenses;
- missing proof of rights;
- low-quality AI spam;
- fake metadata;
- wrong or non-compliant artwork;
- DSP rule violations;
- fraud risk;
- artificial streaming risk;
- cover song licensing issues;
- sample clearance issues;
- unauthorized remixes;
- impersonation;
- explicit content not marked correctly;
- misleading artist names, label names, titles, or copyright lines;
- violation of All Humans Cry policies, distribution partner rules, or DSP rules.
If a release is rejected for a reason outside the user’s control, All Humans Cry may consider a refund only if no releases are approved within the first 30 calendar days after purchase and all other refund conditions in this Policy are satisfied.
If Too Lost, a DSP, or another distribution partner rejects a release, All Humans Cry is not automatically responsible for refunding the subscription. All Humans Cry does not control the independent review, approval, rejection, takedown, or policy decisions of third-party distribution partners or DSPs.
8. No Partial Refunds
All Humans Cry does not provide partial refunds for unused subscription periods unless required by mandatory applicable law or expressly approved by All Humans Cry in writing.
If a user cancels after part of a yearly subscription period has passed, the user is not entitled to a refund for the remaining unused months.
Plan downgrades, plan changes, credits, or prorated adjustments are not currently guaranteed. Where technically supported by Stripe or another payment provider, All Humans Cry may choose to provide prorated credits or adjustments on a case-by-case basis, but this is not guaranteed unless expressly stated in writing.
9. Digital Services and Consumer Withdrawal Rights
All Humans Cry sells digital services and music distribution-related services online to both consumers and business users.
Consumers may have statutory rights under applicable Dutch and EU consumer law, including rights relating to distance contracts and withdrawal periods. Nothing in this Policy is intended to limit any non-waivable consumer rights that apply by law.
However, where permitted by applicable law, consumers may lose or limit their withdrawal rights once digital services have started, provided that the consumer has expressly agreed that the service may begin immediately and has acknowledged that this may affect their withdrawal rights.
At checkout, All Humans Cry may require users to confirm wording similar to:
- I agree that All Humans Cry may begin providing digital services immediately after purchase. I understand that once the service has started, my statutory withdrawal rights may be limited or lost where permitted by applicable law.
Users should not purchase a subscription if they do not want All Humans Cry to begin providing digital services immediately after purchase.
Business users do not generally receive the same statutory consumer withdrawal rights as consumers, unless mandatory law provides otherwise.
Because consumer withdrawal rights may depend on the user’s location, legal status, service type, checkout consent, and applicable law, All Humans Cry may assess withdrawal-related refund requests on a case-by-case basis where legally required.
10. Optional Paid Services
All Humans Cry may offer optional paid services separately from subscriptions, including but not limited to:
- playlist pitching;
- marketing support;
- priority or additional support;
- custom label services;
- other optional services.
Optional paid services are generally non-refundable. Optional services become non-refundable once work has started, preparation has begun, resources have been allocated, a campaign has been scheduled, communication has started, review has begun, or the service has otherwise commenced.
Playlist pitching and marketing support do not guarantee streams, followers, saves, playlist placement, editorial placement, algorithmic placement, income, exposure, audience growth, or any specific commercial result. No refund is owed merely because a playlist pitching or marketing campaign does not achieve the user’s desired outcome.
Custom Label Plan refund and cancellation terms may be agreed on a case-by-case basis in writing.
Setup fees, if introduced in the future, are non-refundable once setup work has started.
Payout fees, bank fees, PayPal fees, Stripe fees, payment provider fees, currency conversion fees, and other third-party financial charges are non-refundable.
11. Failed Payments and Failed Renewals
If a subscription renewal payment fails, All Humans Cry may suspend, restrict, or disable:
- dashboard access;
- uploader access;
- payout requests;
- support ticket access;
- analytics access;
- release tools;
- monetization tools;
- other account features or services.
All Humans Cry may provide a grace period after a failed payment or failed renewal on a case-by-case basis. During a grace period, releases may remain live, but All Humans Cry does not guarantee continued access to dashboard features, payout tools, uploader tools, support tools, or other subscription-based features.
If payment is not resolved after the grace period, releases may become eligible for takedown.
All Humans Cry may take down releases after a period depending on Too Lost, other distribution partners, DSP rules, uptime fees, subscription status, unpaid balances, operational requirements, or All Humans Cry’s business decision.
All Humans Cry does not promise an exact takedown date after cancellation, failed payment, failed renewal, non-payment, or subscription expiry.
12. Releases After Cancellation
If a user cancels their subscription voluntarily, releases may remain live during the current paid subscription period, provided that the account remains in good standing and no fraud, copyright, payment, legal, or compliance issue applies.
After the paid subscription period ends, releases may remain live for a grace period, but All Humans Cry reserves the right to takedown releases if the user does not renew the subscription.
The timing of takedowns after cancellation or non-renewal depends on Too Lost, other distribution partners, DSP rules, uptime fees, release status, account status, operational requirements, and All Humans Cry’s business decision.
Users may still request takedown of their own releases after cancellation by contacting All Humans Cry through the support ticket system or another available support method. If dashboard access is restricted due to no active subscription, takedown requests may need to be submitted through support.
13. Royalties After Cancellation
Cancelled users may not request royalty withdrawals unless they have an active subscription, unless All Humans Cry expressly allows otherwise in writing or mandatory law requires otherwise.
Royalty payouts are subject to the Royalty & Payout Policy, including minimum payout threshold requirements, account status, fraud checks, copyright checks, payout verification, tax information, and any applicable holds, deductions, negative balances, or restrictions.
All Humans Cry may require users to maintain or reactivate an active subscription before requesting withdrawals through the dashboard.
Nothing in this section limits any non-waivable rights that may apply under mandatory law.
14. Chargebacks and Payment Disputes
Chargebacks, payment disputes, payment reversals, failed payments, or disputed transactions may lead to immediate account review.
If a user initiates a chargeback or payment dispute, All Humans Cry may:
- suspend dashboard access;
- suspend uploader access;
- freeze payout requests;
- freeze royalties;
- restrict support access;
- pause release delivery;
- remove or takedown releases if unresolved;
- reject future submissions;
- suspend the account;
- terminate the account;
- refuse refunds;
- recover chargeback fees, bank fees, Stripe fees, legal costs, administrative costs, and losses caused by the chargeback.
Improper or abusive chargebacks may result in loss of refund rights.
Repeated chargebacks may result in account termination.
A chargeback does not cancel the user’s obligations under the Terms of Service, this Policy, the Royalty & Payout Policy, the Anti-Fraud Policy, or the Copyright & Takedown Policy.
15. Account Termination and Refunds
If All Humans Cry terminates an account for serious breach, no refund is owed to the fullest extent permitted by law.
Serious breach includes, but is not limited to:
- fraud;
- artificial streaming;
- copyright infringement;
- payment fraud;
- chargebacks;
- fake tax details;
- fake identity information;
- misleading metadata;
- abusive behavior;
- DSP complaints;
- distribution partner complaints;
- illegal content;
- violation of the Terms of Service;
- violation of the Anti-Fraud Policy;
- violation of the Copyright & Takedown Policy;
- violation of the Royalty & Payout Policy;
- other conduct creating legal, financial, operational, reputational, payment, copyright, fraud, or partner risk.
If All Humans Cry terminates an account for business or operational reasons not caused by the user, All Humans Cry may consider a refund, credit, or other solution on a case-by-case basis.
16. Refund Request Process
Refund requests must be submitted to:
Where applicable, users may also manage payment or subscription-related requests through the Stripe portal.
A refund request should include:
- full name;
- account email;
- order ID or subscription ID, if available;
- reason for refund;
- confirmation that no releases were submitted,
- or an explanation of the situation;
- payment date;
- payment method;
- any other information reasonably requested by All Humans Cry.
All Humans Cry may request additional information before reviewing or approving a refund.
17. Refund Review Time
All Humans Cry may take up to 30 business days to review a refund request.
Review time may depend on account history, release activity, service usage, Stripe records, payment status, fraud checks, copyright checks, support history, subscription status, and whether additional information is required.
Submitting a refund request does not guarantee that the refund will be approved.
18. Approved Refund Processing Time
If a refund is approved, the time required for the funds to appear in the user’s account depends on Stripe, the user’s bank, card issuer, payment provider, PayPal where applicable, and other financial institutions involved.
All Humans Cry is not responsible for delays caused by Stripe, banks, card issuers, payment providers, or other third parties after a refund has been approved and processed.
19. No Guarantee of Results
No refund is owed because a user does not achieve a desired commercial result.
All Humans Cry does not guarantee:
- streams;
- followers;
- saves;
- playlist placement;
- editorial placement;
- algorithmic placement;
- income;
- royalties;
- artist verification;
- DSP approval;
- release date;
- marketing success;
- audience growth;
- social media growth;
- YouTube Content ID results;
- TikTok, Instagram, or Facebook monetization results.
Dissatisfaction with commercial performance, audience response, royalties, streaming results, marketing outcome, or playlist pitching outcome does not by itself create a refund right.
20. Changes to this Policy
All Humans Cry may update this Policy from time to time for legal, operational, payment, subscription, consumer law, DSP, distribution partner, compliance, fraud prevention, or business reasons.
If changes are material, All Humans Cry may notify active users by email, dashboard notice, website notice, updated policy publication, or renewed acceptance requirement.
Continued use of the services after an updated Policy becomes effective constitutes acceptance of the updated Policy, unless mandatory law requires a different process.
